Dixie River Land Company, LLC has requested an access easement to permit use of the private driveway located at Berewick Elementary School for access to the adjacent, future Laurel Street Apartment Property.
The non-exclusive, perpetual easement will be for the purpose of pedestrian and vehicular ingress, egress, and regress over and across the private access driveway located on the Berewick Elementary School property and used by Mecklenburg County. Use of the driveway for construction entrance, exit, or staging purposes will be prohibited at all times. CMS will reserve the right to terminate the access easement if the adjacent property is recombined with any adjacent parcels, due to heavy through traffic from properties other than the adjacent property, or for any unforeseen reason(s) that pose a problem for the operation of Berewick Elementary School or the Mecklenburg County Berewick Regional Park Property.
Mecklenburg County staff has approved the easement and took a leading role in negotiating the easement. The Grantee shall have responsibility to complete some improvements and share in the maintenance costs.
